What Is Code of Practice 8?

Code of Practice 8 (COP8) is used by HMRC when they suspect serious tax avoidance — as opposed to tax fraud. While COP9 deals with deliberate fraud, COP8 covers cases where HMRC believes a taxpayer has used artificial or contrived arrangements to reduce their tax liability, but where there is no suspicion of criminal behaviour.

Receiving a COP8 notice means HMRC wants to examine whether your tax affairs include arrangements that, while not illegal, go beyond what HMRC considers acceptable tax planning.

How Does COP8 Differ from COP9?

  • COP8: Targets serious tax avoidance (legal but aggressive schemes). No criminal prosecution threat.
  • COP9: Targets suspected deliberate tax fraud. Comes with the threat of criminal prosecution if the CDF is not accepted.

However, if during a COP8 investigation HMRC discovers evidence of fraud, the case may be escalated to COP9.

  • Issuing formal information notices under Schedule 36 Finance Act 2008
